Terms of Service

Effective date: September 10, 2026

1. Acceptance of terms

These Terms of Service govern your use of Brayniak's websites, accounts, courses, subscriptions, and course communities, together called the Service. By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and acknowledge the Privacy Policy.

2. Eligibility and account responsibility

You must be able to enter into a binding agreement to use the Service. The Service is not intended for children under 13. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.

You are responsible for providing accurate account information, safeguarding your credentials, and activity under your account. Tell us promptly through the Contact page if you believe your account has been compromised.

3. Course subscriptions

Brayniak subscriptions are course scoped. Unless otherwise stated, each subscription unlocks only the course associated with that subscription.

The current base subscription price for AI Website Business Blueprint is $29.95/month. The current price and billing terms are shown before purchase. Brayniak may change prices for future purchases. Any price change affecting an existing subscription or future renewal will be communicated and handled consistently with the agreed billing relationship and applicable law.

4. Recurring billing

Course subscriptions renew automatically until canceled. Stripe processes subscription billing and charges the payment method provided through its checkout service. Applicable taxes may be charged where required. Failed or incomplete payments may affect course access according to the subscription's current status.

5. Cancellation

You may cancel future renewals through the available account controls. A cancellation request may require processing or confirmation. Once cancellation is established, access remains available through the paid subscription period. After that period ends, access associated with that subscription ends unless another valid basis for access applies.

6. Refunds

Payments are generally nonrefundable except where required by law.

If consumer withdrawal rights apply where you live, you may have a period in which to withdraw from a subscription. Applicable law may permit a proportionate charge for service provided before you tell us you are withdrawing. Nothing in this section limits rights that cannot be limited under applicable law.

Canceling stops future renewal charges after cancellation is established, but it does not generally create a refund for a billing period that has already been paid.

7. Promotion codes

Promotional offers may have separate eligibility, product, duration, expiration, and redemption rules. Stripe may validate promotion codes during checkout. Promotional terms do not change the normal base subscription price unless the offer explicitly states otherwise.

8. Course access

Course access depends on an eligible account and subscription or other authorized access status. A subscription unlocks only its associated course unless Brayniak states otherwise. You may not share account credentials or allow another person to use your account to access protected course materials.

9. Educational and business disclaimer

Course materials are provided for educational purposes. Results vary based on individual experience, effort, judgment, market conditions, and other factors. Brayniak and its instructors do not guarantee clients, income, employment, project values, business success, or any other specific result.

10. Intellectual property and permitted use

Brayniak and Web Fueled course materials, prompts, written content, branding, and other protected materials remain owned by their respective rights holders.

You may use what you learn to create your own websites, build a portfolio, perform client work, and provide commercial services. You may not copy or resell the course itself, redistribute course materials, publish substantial protected course content, share account access, or reproduce the materials for distribution as a competing course.

11. Community rules

You may not submit unlawful, harassing, threatening, abusive, fraudulent, malicious, infringing, or spam content, or content that impersonates another person. You may not interfere with the Service, misuse another person's information, or attempt to harm other users.

Brayniak may review, moderate, restrict, or remove content and may limit or suspend access where reasonably appropriate to protect users, course communities, and the Service.

12. User submitted content

You retain the rights you already have in content you submit. You give Brayniak a limited, nonexclusive permission to store, process, reproduce, and display that content only as reasonably necessary to host it, provide community features, moderate it, secure the Service, and operate the features you choose to use.

You are responsible for having the rights needed to submit your content.

13. Service availability and changes

Brayniak may reasonably update or change Service features and course availability over time. We do not promise that every feature or course will always remain available or that the Service will operate without interruption or error. We will not use this section to override rights that cannot be waived under applicable law.

14. Suspension and termination

Brayniak may restrict, suspend, or terminate access when reasonably necessary because of a serious or repeated violation of these Terms, abuse, fraud, a security risk, unlawful use, or nonpayment where relevant. We will apply these measures proportionately when circumstances allow.

15. Third party services

The Service relies on third party services for certain functions. Stripe provides payment processing and subscription billing under its own terms and policies. Brayniak is not responsible for a third party service beyond the extent required by applicable law.

16. Disclaimer of warranties

To the fullest extent allowed by law, the Service and course materials are provided as available. We do not promise that the Service will always be uninterrupted, error free, or suitable for every purpose. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

17. Limitation of liability

To the fullest extent allowed by law, Brayniak and its instructors will not be responsible for indirect, incidental, special, or consequential losses arising from use of the Service. Brayniak's responsibility will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability where a limitation is prohibited by law.

18. Governing law

These Terms are governed by the laws of the State of New York, United States, without taking away consumer protections that cannot be waived under the law that applies to you. These Terms do not create a mandatory arbitration requirement or class action waiver.

19. Changes to these Terms

We may update these Terms as the Service changes. When we update them, we will revise the Effective Date shown at the top of this page. Where required, we will provide additional notice or request consent.
